The proposed SECOM charter has been revised in the manner described in paragraph 3 of Reference. The revision is not considered objectionable in that no misunderstanding exists on our part regarding the criminal investigatory functions of the Federal Bureau of Investigation and the prerogative of the Department of Justice to prosecute. Rather, we have been frus- trated in the failure of these agencies to investigate or prosecute in instances involving leaks. The revision permits security investigation of leaks by components of the Intelligence Community and does not preclude administrative action deemed appropriate as a sanction when the source of an unauthorized disclosure of intelligence sources and methods is identified. 2. It is recommended that SECOM be advised of no ('IA objections to the proposed revision. In view of the deadline, it is suggested our response be telephonic and that this memo serve as documentation of our position.
