SUBJECT: Draft DoJ and GSA Letters on H.R. 39 "Federal
Polygraph Limitation and Anti-Censorship Act of 1984"
1. The Justice Department letter is excellent. It faces the issues
squarely and states a firm Executive Branch position. The GSA letter seems
bureaucratic in tone and defensive in character.
2. The only specific change I'd make in the Justice Department letter
regards the third paragraph on page 3. It is suggested that the following be
added after the second sentence to point out that "The explicit prepublication
review clause benefits the recipient of SCI by making clear first, his/her
obligation not to disclose SCI without government approval, and second, that
the obligation does not apply to writings or statements on non-intelligence
subjects. Prohibition of the review clause would be detrimental to both the
government and the individual."
