IN THE HOUSE OF REPRESENTATIVES AUGUST 1, 1985 Mr. McDADE introduced the following bill; which was referred jointly to the Committees on Armed Services, the Judiciary, Government Operations, and Foreign Affairs A BILL To strengthen the counterintelligence capabilities of the Depart- ment of Defense, to amend the Uniform Code of Military Justice to establish penalties for espionage in peacetime, to create a Presidential Commission to study the effectiveness of the changes made in this legislation, to provide increased penalties for espionage, and for other purposes. 1 Be it enacted by the Senate and House of Representa- 2 tives of the United States of America in Congress assembled, 3 SHORT TITLE 4 SECTION 1. This Act may be cited as the "National 5 Security Reform Act of 1985". (a) The President shall appoint a commission 4 representative of the communications, the scientific, business, 5 government and the intelligence communities to examine and 6 report to the Congress within ninety days after the date of 7 enactment of this Act on the impact of: 8 (1) the provisions of the Freedom of Information 9 Act on the counterintelligence capabilities of the 10 United States. The President shall instruct the Com- 11 mission to recommend appropriate changes to the 12 Freedom of Information Act to -protect the security of 13 the United States, while ensuring the civil liberties of 14 the citizenry, and 15 (2) such other findings as the Commission deems 16 important. 17 LIMIT ON THE NUMBERS OF FOREIGN AGENTS 18 SEC. 3. The President shall limit the number of diplo- 19 matic personnel and agents within the United States from 20 any particular foreign government to an amount equal to the 21 number of United States diplomatic personnel and agents 22 serving in that foreign government's country. 23 POLYGRAPH EXAMINATIONS FOR COUNTERINTELLIGENCE 24 SEC. 4.
