Dear Stan:
Reference is made to your letter dated December 15,
1978, forwarding draft procedures for CIA counterintelligence
activities in the United States as required pursuant to
Section 1-805 of Executive Order 12036.
In concurring with and approving those procedures
I wish to call to your attention that while the procedures
establish a process for securing the Attorney General's approval
of a specific counterintelligence activity by the CIA in the
United States they do not establish any guidelines for the
conduct of that activity. In my judgment it would be more
appropriate to establish such guidelines for each situation
at the time it is proposed rather than to attempt now to
anticipate all possibilities. At such time as a specific
request is submitted to the FBI under these procedures, however,
the scope of the activity and the specific means to accomplish
the objective should be set forth in the CIA request.
Finally, while I recognize that the definition of
"counterintelligence" in Executive Order 12036 specifically
excludes personnel security programs I think it would be
beneficial to develop a memorandum of understanding which
better defines your Agency's and this Bureau's responsibilities

with regard to inquiries necessary to resolve situations which
may be perceived initially as security problems by your Agency
but which at the same time are perceived as counterintelligence
matters by this Bureau.
