Sections 1 and 6 of E.O. 12065 refer to the Atomic Energy Act of 1954,
as amended, as the sole authority classification, downgrading and declassilficationhofdinformationcand/or
on,
documents containing Restricted Data and Formerly Restricted Data. The
Department of Energy Organization Act of 1977 (P L. 95-91) transferred
to the DOE the Atomic Energy Act security responsibilities of its
predecessor agencies.
The Department of Energy (DOE) does not inspect other Federal departments
and agencies to insure that Restricted Data is protected in accordance
with DOE standards. As an alternative we rely upon written assurances
furnished by the Security Director or other responsible security official
of all Federal departments or agencies concerned that Restricted Data and/
or Formerly Restricted Data Information in its possession, or in the
possession of its contractors, subcontractors or consultants, is and will
continue to be physically protected in a manner consistent with Executive
Order 12065 and DOE standards. Further, that the personnel security
requirements of the Atomic Energy Act of 1954 pertaining to access to
Restricted Data ("Q" or "L" access authorizations granted by the DOE
Office of Safeguards and Security) are and will continue to be met.
We, therefore, respectfully request your assurance that Restricted Data
or Formerly Restricted Data in the possession of your Department or agency
is provided such protection. There is enclosed herewith a copy of our
DOE review completed.
