C. 2030t U-69/OS 12 SEP 1985 MEMORANDUM FOR THE CHAIRMAN, DCI SECURITY COMMITTEE SUBJECT: Library Access for the Rand Corporation References: a. Director of Central Intelligence Directive, "Security Controls on the Dissemination of Intelligence Information (U)," 1 January b. 1984 (DCID 1/7). OUSDRE memorandum, 22 April 1985, subject as above. 1. The Director, Federally Funded Research and Development Center (FFRDC) Programs Office, Office of the Under Secretary of Defense, Research and Engineer- ing, has requested Director, DIA grant authorization to a particular element of the Rand Corporation for access to intelligence information (enclosure 1). His specific request is that the OSD/OJCS Federally Funded Research and Develop- ment Center element of the Rand Corporation be accorded access to caveated intelligence marked "NOT RELEASABLE TO CONTRACTORS/CONSULTANTS" (NO CONTRACT) and "CAUTION - PROPRIETARY INFORMATION INVOLVED" (PROPIN) without approval of the originator on a case-by-case basis, similar to that provided to the Institute for Defense Analyses (IDA) by DCI Security Committee (SECOM) on 21 April 1982. 2. In order to assist the SECOM in considering the request, the undersigned discussed this request with CO1 T. L. Ricketts, Director, OSD FFRDC Program Office to gain a better understanding of the scope and nature of the request. Col Ricketts advised that although not specifically stated in this memorandum, the waiver is being requested only for a very small element of the Rand Corpo- ration. This element, known as the OSD/OJCS FFRDC element of Rand, is devoted exclusively to contracts originated by the Office of the Secretary of Defense (OSD) and the Organization of the Joint Chiefs of Staff (OJCS). This waiver does not pertain, nor will it apply to, any other FFRDC element of Rand which may perform contracts for Army, Air Force, etc. Col Ricketts provided a copy of a memorandum which establishes the Rand Corporation as a Federally Funded Contract Research Center (enclosure 2). He further noted that the requested relationship of OSD/Rand is perceived to be no different from that which now exists between OSD/IDA. 3. Col Ricketts advised that procedurally, the material requested by the OSD/OJCS FFRDC element of Rand will be handled as follows: The OSD/OJCS FFRDC element will identify to Col Ricketts that intelligence information/ documents they consider necessary to fulfill the terms of the contract; Col Ricketts will review the request and validate/authenticate the require- ment in connection with an existing contract; he will then request, the DIA Library to provide the necessary documents to him and he in turn will provide the material to the OSD/OJCS FFRDC element of Rand. Also, I am able to verify that the Rand Corporation does have a Sensitive Compartmented Intelligence Facility (SCIF) accredited by this Agency and for which we maintain SCI security cognizance. Should this waiver be approved by the SECOM, DIA will ensure that SCI material received by, and stored at the OSD/OJCS FFRDC element of Rand is segregated from other material stored in the Rand SCIF. Further, during the course of regular inspections of the'Rand SCIF, DIA will verify that proper handling procedures are being followed regarding the caveated SCI intelligence material furnished in connection with satisfaction of OSD/OJCS contracts. 5. Based on available information, it is our opinion.that the relationship between DoD and Rand could be considered the same as that between the Department of Energy and government owned contractor laboratories as specified in footnote 6. of reference a. Accordingly, in this specific instance, the OSD/OJCS FFRDC segment of Rand should not be considered a contractor for purposes of control of dissemination of intelligence. Intelligence bearing NO CONTRACT or PROPIN that the OUSDRE determines to be necessary for accomplishment of the mission of the DoD should be considered eligible for release by the Defense Intelligence Agency to Rand through OUSDRE. 6. Therefore, DIA recommends the SECOM: a. Include this matter as an agenda/discussion at its 18 September 1985 meeting; and b. Approve the request for waiver of NOCONTRACT and PROPIN requirements of reference a., (DCID 1/7) which would authorize the OSD/OJCS FFRDC element of Rand Corporation access to NOCONTRACT and PROPIN without permission of the originator. 7.
