On 5 May 1983,1 I from our Office of Security, and
our Associate General Counsel for Administrative Law
Division, provided you with a copy of my memorandum to the Acting Director
of Central Intelligence, dated 7 April 1983, outlining the Agency's
existing policies and regulations with regard to the implementation of
National Security Decision Directive 84 (NSDD-84). That memorandum, a copy
of which is enclosed at Tab A, constituted my response to your April letter
in which you asked the CIA to submit to you implementing regulations on
NSDD-84. Attached to my memorandum were copies of the following
nondisclosure agreements and extracts of Agency regulations that
specifically address the major requirements of NSDD-84:
Also included in this package was a proposed Agency regulation that
discussed policies and procedures on damage assessments. For your
convenience, I am again providing copies of these documents at Tab B.

In response to your letter of. 10 June 1983, I am enclosing at Tab C a
copy of Agency Information Security Program, which should have
been included with the submission provided by Messrs. on 25X1
5 May 1983. This regulation includes sanctions that may be imposed upon
Agency personnel, contractors, licensees, and grantees, who knowingly,
willfully, or negligently disclose classified information to unauthorized
persons. also provides that the Agency notify the Director,
Information Security Oversight Office (ISOO) of such disclosures, in
accordance with procedures established by ISOO whenever an unauthorized
disclosure occurs.
Based on our review of the regulations cited above, we believe that
the Agency is in compliance with the requirements of NSDD-84 except for the
exceptions cited in my 7 April 1983 memorandum. Please let us know if you
agree with this assessment and if the cited exceptions fall within the
intent of the President's Directive.
