Ackerman Chairman Subcommittee on Human Resources Committee on Post Office and Civil Service U.S. House of Representatives Washington, D.C. 20515 I have been asked to respond to your 17 April 1985 letter to Director Casey requesting data on the Agency's utilization of temporary employees and its compliance with the Office of Personnel Management's new regulations concerning the hiring of temporary employees, as outlined in FPM Letter 316-21, dated 2 January 1985. As you may be aware, the Central Intelligence Agency (CIA) possesses independent statutory authority under Section 8 (a)(1) of the CIA Act of 1949, as amended, 50 U.S.C. Section 403j(a)(1), to hire and appoint persons as necessary to carry out Agency functions. Because of this independent authority, Agency employment practices are not affected by the FPM letter. Given this fact, I trust that your request for detailed information about CIA employees and job descriptions, which would be classified, is not pertinent to your current inquiry.
