I have been asked to respond to your 17 April 1985 letter
to Director Casey requesting data on the Agency's utilization
of temporary employees and its compliance with the Office of
Personnel Management's new regulations concerning the hiring of
temporary employees, as outlined in FPM Letter 316-21, dated
2 January 1985.
As you may be aware, the Central Intelligence Agency (CIA)
possesses independent statutory authority under Section 8
(a)(1) of the CIA Act of 1949, as amended, 50 U.S.C. Section
403j(a)(1), to hire and appoint persons as necessary to carry
out Agency functions. Because of this independent authority,
Agency employment practices are not affected by the FPM letter.
Given this fact, I trust that your request for detailed
information about CIA employees and job descriptions, which
would be classified, is not pertinent to your current inquiry.
I hope that this response will be helpful in your review of
federal agency compliance with the OPM regulation cited above.
