Webst''`&rector Subject: INTELLIGENCE COM1!UNITY LEGISLATIVE PROGRAM FOR THE SECOND SESSION OF THE 99TH CONGRESS 85-3906 Reference is made to your memorandum dated September 13, 1985, in which you requested a listing and brief description of various legislative initiatives which we antic- ipate recommending during the next session of the 99th Congress. AMENDMENTS TO THE FREEDOM OF INFORMATION ACT These amendments would better enable us to protect sensitive information and the identities of confidential sources from public disclosure. EXCLUSIVE TERRORISM JURISDICTION This proposal would provide discretion to the Attorney General or his designee to exercise exclusive juris- diction for terrorist investigations. EXPEDITIOUS DEPORTATION OF TERRORIST ALIENS The FBI will continue to work with the Department of Justice in an effort to streamline the procedures by which aliens engaged in terrorist activities may be summarily deported. /. _4~) ? ~_ Approved For Release 2009/09/18: CIA-RDP87M00539R002203530024-8 Approved For Release 2009/09/18: CIA-RDP87M00539R002203530024-8 Director Central Intelligence Agency RIGHT TO FINANCIAL PRIVACY ACT AMENDMENTS To require financial institutions to disclose requested records in foreign counterintelligence investigations. PERMANENT UNDERCOVER AUTHORITIES Current law, expressed in annual authorization bills, permits the FBI to be exempt from certain statutes if doing so is necessary to conduct undercover operations. We continue to advocate permanent exemption authority for undercover operations. We also recommend clear legislative authority to lease space, without disclosing the Government's involvement, for surveillances and monitoring Title III and Foreign Intelligence Surveillance Act intercepts in other than undercover operations. ACCESS TO TAX RETURN INFORMATION IN FOREIGN COUNTER- INTELLIGENCE INVESTIGATIONS Provide authority in foreign counterintelligence cases to receive tax return and taxpayer information regarding those individuals who are the subjects of those investigations. ACCESS TO TELEPHONE TOLL RECORDS Provide authority in foreign counterintelligence cases to receive telephone toll record information pursuant to national security letters which are being denied pursuant to certain state privacy statutes, especially in California. FOREIGN EXECUTIVE EXCHANGE PROGRAM This proposal would create statutory authority to budget funds for a foreign vistor exchange program similar to that in effect at other U. S. Government agencies. The Office of Management and Budget requires that the head of each Federal agency submit a proposed legislative program for Administration clearance each fall for the session of Congress which begins the following January. This memorandum initiates the process of formulating the Central Intelligence Agency legislative program for the Second Session of the Ninety- Ninth Congress, and the Agency's contribution to the Intelligence Community program that also will be submitted by the Director of Central Intelligence. 2. The following guidelines are provided to aid your component in the preparation of proposals for inclusion in the legislative program: -- Items contained in the current legislative program, a copy of which is attached for your information, should be repeated to indicate a continued interest in the passage of these initiatives; -- It is not necessary to submit specific statutory language, or to specify a statute to be amended. A description of each problem or goal, accompanied by an explanation of why it is thought that legislation is necessary to solve or achieve it, is sufficient; and - All suggestions also should be accompanied by your component's views as to whether or not the proposal has Intelligence Community applicability. 3.
