Chairman, Japan IG SUBJECT: Status Report on MOSS Negotiations A series of meetings was held in Tokyo March 11 through 18, including the MOSS groups on Telecommunications, Medical Equipment and Pharmaceuticals, and Electronics, the Economic Sub-Cabinet consultations, the Trade Committee, and a MOSS plenary session. Following is a status report on the MOSS negotiations. Telecommunications: The full MOSS Telecommunications group has met four times. In addition, experts from USTR and DOC remained in Tokyo from February 22 through March 15 analyzing the ordinances as they were written and translated, and meeting daily with the Ministry of Posts and Telecommunications to resolve technical problems. On March 13 we gave the GOJ in writing the four principles and nine specific issues which the SIG-IEP had approved as USG objectives. The GOJ responded orally on March 15 and in writing March 17. In my view none of the four principles has been met. There have been varying degrees of progress on the nine specific issues on which you may wish to ask Lionel Olmer to report orally. Under the ordinances as currently drafted, the GOJ retains sufficient authority to restrict foreign access to the telecommunications equipment and VANs markets. Electronics: The Electronics MOSS group has met twice. Exhibiting a generally positive approach, MITI has proposed three specific issues for short-term progress: 1. Software: MITI has abandoned its attempts of last year to remove copyright protection for software. Japan's Copyright Law will be amended explicitly to cover software. Ambassador Brock has publicly commended the GOJ for this change in policy. 2. Chip Protection Bill: While some issues remain unresolved, the GOJ appears to be moving in the right direction. 3. Tariffs: MITI is proposing a mutual elimination of tariffs in a broad range of electronics products. We are translating the specific proposal and will be reviewing it with concerned industry associations in the next few weeks to determine private sector interest.
