Enclosed for your review and comment is one copy of our
declassified draft report entitled Nazis and Axis Collaborators
Used To Further U.S. Anticommunist Objectives In Europe--Some
Came To The United States. The Chairman of the House Committee
on the Judiciary and several Members of Congress requested this
report as a followup to our 1978 investigation regarding alleged
Nazi war criminals residing in the United States.
This draft report is subject to revision and under no cir-
cumstances should its contents be released or used for purposes
other than official review and comment. At all times it must be
safeguarded to prevent publication or other improper disclosure.
This draft and all copies remain the property of the General
Accounting Office and must be returned upon request.
Since the Chairman has requested an issuance report date of
June 30, we ask that your official comments be provided to us
within 10 days from the date of this letter. To expedite this
request we would like to meet with you or your staff to discuss
the report and obtain your comments within that timeframe.
We are also sending copies of this draft report to the
Immigration and Naturalization Service, the Federal Bureau of
Investigation, the Department of Justice, the Department of
State, and the Department of Defense for review and comment.

In May 29781 your office issued a report, requested by the House
Judiciary Committee, on the investigation of suspected Nazi war criminals
in the United States. The report concluded that available evidence did
not support the theory that there was a widespread conspiracy to obstruct
probes of alleged war criminals, although there was a possibility of
"undetected, isolated instances of deliberate obstruction".
At the time the report was issued, some Committee Members expressed
skepticism about its conclusion in view of the fact that GAO investiga-
tors had not been given access to certain information in the files cf
the CIA and other government agencies. On the May 16 edition of the tele-
vision program 060 Minutes", it was reported that the files of certain
federal agencies -- not previously made available -- in fact contained
voluminous information suggesting that there might have been a conscious
effort to bring Nazi war criminals to this country in violation of our
immigration laws and to protect them once they were admitted.
Clearly, if the allegations raised on "60 Minutes" are true, a great
deal of vital information was previously withheld from GAO investigators,
and the conclusion of your 1978 report must be called into question.
Indeed, GAO employee John Tipton, the author of the report, appeared on
the program and stated, after reviewing certain new information, that
"it seems to be the case" that government agencies misled GAO and Congress.
In light of this, I ask you to reopen the earlier investigation and
report to the Committee as expeditiously as possible any new findings.
