Action Requested: None. For your information. 2. Back round: Pursuant to a recent vulnerability study of t e Headquarters compound, the Office of Security is developing a new contingency plan designed to ensure a coordinated, effective response to any terrorist action or hostage situation that might develop on the Headquarters compound. The Office of General Counsel (OGC) has determined that the Federal Government and the Commonwealth of Virginia have concurrent jurisdiction over crimes and offenses committed on Headquarters property. To avoid possible confusion arising from the phrase "concurrent jurisdiction," the new plan will clarify the specific responsibilities of both the FBI and the Fairfax County Police following a terrorist attack. The initial response to terrorist action on the compound will be from the Fairfax County Police due to their proximity to Headquarters. The police response can include a SWAT capability if warranted by the circumstances. The police will secure the perimeters, locate and contain the terrorists, and maintain their positions until relieved.
