GEORGE BUSH, being first duly sworn,, deposes and says:
1. I am the Director of Central Intelligence ("DCI") and have served
in that office since January 30, 1976. In my capacity as DCI, I am executive
head of the Central Intelligence Agency ("CIA").
2., I have been informed that the CIA has filed answers and objections
dated November 18, 1976, to plaintiffs' interrogatories and has filed
responses dated November 22, 1976, to plaintiffs! requests for production
of documents.
3. I have personally reviewed the material within the purview of
plaintiffs' pending motion to compel further discovery from the CIA with
respect to the discovery requests referred to in paragraph 2 above. On
the basis of that review, I have concluded that certain requested documents and
information fall within the category of material protected from disclosure under
50 U . S . C . ?403(d) and 50 U . S . C . ?403g and the privilege afforded secrets of
state. Moreover, based upon my review, I have concluded that disclosure

of this material will seriously impair the ability of the CIA to collect foreign
intelligence abroad.
Accordingly, I have executed an in camera affidavit and Claim
of Privilege, formally asserting these privileges with respect to the disclosure
of the material referred to in paragraph 3 above. The interrogatories and
