SUBJECT: Revision (s) of Title 4 ("Claims") of the GAO Policy
and Procedures Manual for Guidance of Federal Agencies
1. We have reviewed the subject document and do not find any specific
provisions which are particularly objectionable from an Office of Personnel
standpoint, or which are especially harmful to OP equities. It is our
understanding, based on experience and on informal consultation with the
Office of General Counsel, that the Agency's interest in protecting sensitive
personnel information in the GAO/claims context already is essentially
accommodated by statutory exemptions(s) from GAO rules and/or by agreement
(MOU) with GAO. While it might be desirable for CIA to be exempted explicitly
in Title 4 of the subject Manual from all GAO jurisdiction over claims against
(and perhaps, by) the Agency, such an exclusion would be resisted strongly by
GAO, could require legislation, and probably is not appropriately raised in
the course of the subject exercise.
2. Finally, there is one minor change that would make one section of the
Manual more accurate -- i.e., revising Chapter 3, Section 23.2a(2), on page
4-21 to read as follows:
"Federal Civilian Retirement Systems. If the decedent was
subject to the provisions of the Civil Service Retirement
Act, as amended, or another federal civilian retirement
system, his current earnings up to and including the date
of death are subject to deductions for the Civil Service
Retirement Fund or for the fund established for the federal
civilian retirement system in which the decedent was a
participant."
This change would reflect the fact that the rule under CIARDS in this regard
is the same as the rule for the CSRS.
