As you are aware, we held a meeting on August 13 with
Executive branch legal counsels concerning Congressional
notification and reporting requirements related to potential
counter-terrorist operations. We were pleased by the
willingness of Administration officials to discuss the
difficult issues in this area on an informal basis.
In view of our belief that confidence between the
Legislative and Executive branches of government can best
be reached in this area through informal consultations, we
ask that you and a staff assistant participate in another
informal session on this subject with members of the
Committee. We have scheduled this session for October 1,
1986, at 4:00 p.m. in room SH-219 of the Hart Senate Office
Building.
Another opportunity to discuss these matters prior to
the Fall recess would leave us in good position to keep
abreast of activities through the remainder of the year as
well as provide a foundation for further consideration of
counter-terrorist issues during the next Congress. We
understand that interagency coordination is currently
underway on finalizing written responses to issues raised
in a staff memorandum we circulated at the previous meeting,
and have asked Judge Sofaer's office to provide the written
materials to us by close of business Thursday, September 25.

1. Attached is a letter I received on Friday afternoon
from the SSCI inviting me to attend an "informal session" on
October 1 to discuss congressional notification and
reporting requirements related to potential counterterrorist
operations.
2. The attached memorandum dated August 12 was
distributed at an August 13 meeting with Executive Branch
legal counsels to discuss the same subject. I had not been
invited to the August 13 meeting.
3. As you can see from the letter of invitation, the
Committee is anticipating a written response to the
hypotheticals set forth in the August 12 memoranda.
