The Federal Aviation Administration (FAA) is considering contracting
services for the operation of at least one of our several communications
centers. Contracting for this type of service is provided for in the
Industrial Security Regulation, DOD 5220-22R; NCSC-2, National Policy on
Release of Communications Security Information to U.S. Contractors and
other U.S. Nongovernmental Sources; and OMB Circular A-76, Policies for
Acquiring Commercial or Industrial Products and Services Needed by the
Government.
A question has arisen concerning the propriety of this contracting effort
as some message traffic from your agency--which would be handled by the
contractor--is marked "NO CONTRACT." It is, of course, imperative that
all messages now received by FAA from your agency continue to be received
unabated.
Can we move forward on this contracting effort as far as your agency is
concerned, or must we discontinue the effort based on your agency's need
for withholding any contractor's access to "NO CONTRACT" information?
Perhaps there is something that can be done to assure you reasonably of a
contractor's suitability for handling and safeguarding "NO CONTRACT"
information.
As an early decision must be made concerning this matter, I would
appreciate receiving your comments/recommendations as soon as possible.

either Mr. John Ryan or Mr. Norman Cherry of the Office of Civil Aviation
