E. Morriss U lli'~hti__ l6- Deputy Manager National Communications System SUBJECT: Comments on Proposed National Communications System Directive 2-2 and Sample Interagency Funding Agreement 1. As requested at the October 23, 1986 National Communications System (NCS), Council of Representatives meeting, the following suggested changes are provided regarding NCS documents 701/1 and 701/2. 2. We continue to believe that the shared funding concept is not in the best interest of the NCS or the member agencies. We will, however, support the development of the National Level Program (NLP) with funding levels which receive final approval in the Congressional Budget process. It is requested that the following clarifications be added to the documents in question, (words underlined indicate changes). a. Paragraph 4, NCS #701/1: "Written agreements shall be executed between each NCS organization and the Manager, NCS, to govern the transfer of Congressionally authorized and appropriated national level program funds." b. Paragraph 6. h. , NCS #701/1: "Written funding documents executed annually between the Manager, NCS, and each NCS member organization that provide for the transfer of Congressionally authorized and appropriated NLP funds to the Manager, NCS." c. Paragraph 7.c.(2), NCS #701/1: "Oversee the program and financial management of national level NSEP telecommunications programs, reporting quarterly on program status (to include expenditure of funds) to the NCS Committee of Principals." d. Paragraph 8.b., NCS #701/1: "The shared funding of national level NSEP telecommunications programs will be accomplished through the execution, between each NCS member organization and the Manager, NCS, of an agency-specific NLP Funding Memorandum of Agreement, Interagency Funding Agreements, and vouchers for the transfer of Congressionally authorized and appropriated funds." Paragraph 8.b.(3), NCS #701: "Vouchers For Transfers Between Approriations And/Or Funds (GAO Form 1080) will be forwarded by the Manager, NCS, to each NCS member organization prior to the start of the fiscal year in which Congressionally authorized and appropriated NLP funds are to be expended, and will be signed and returned by each organization upon receipt of appropriated funds (or Continuing Resolution)." g. Appendix C. Paragraph 3.c., NCO' #701/1: "The determination, by Federal departments and agencies, of their NSEP telecommunications requirements and the provision, after consultation with the Office of Management and Budget (011B), of Congressionally authorized and appropriated resources to support their respective requirements for NSEP telecommunications." h. Paragraph 4.1.b., NCS #701/1: "Upon approval of national level programs and receipt of funding guidance from the EOP, prepare Interagency Agreements necessary to effect the transfer/advancement of (name of NCS member organization) Congressionally authorized and appropriated funds to the Manager, NCS." i. Appendix C. Paragraph 4.2.b., NCS #701/1: "Prepare and execute with the Manager, NCS, by August 31 of each year the Interagency Funding Agreements required for the transfer, advancement and/or reimbursement of Congressionally authorized and appropriated national level program funds." j. Appendix C. Paragraph 5.0, NCS #701/1: "This MOA is effective upon the date of the latest signature. This MOA is subject to periodic review and update as circumstances warrant and will terminate upon the mutual agreement of the parties. Compliance with this HOA is subject to the authorization and appropriation of NLP funds by the Congress." In this regard, add Paragraph V, NCS #701/2: "Due to security restrictions of CIA, no unclassified release of funding information is authorized."
