E. Morris Deputy Manager National Communications System SUBJECT: Comments on Proposed National Communications System Issuance System Directives 1-1 and 1-2, and Manual 1-1-1 1. As requested at the 23 October 1986 National Communications System (NCS), Council of Representatives (COR) meeting, NCS documents 696/1, 697/1 and 698/1 have been reviewed by this Agency. The documents were provided to our Office of General Council (OGC) who, in turn, contacted your legal staff. Several issues were discussed and/or resolved by these staffs. lie wish to make the following two items a matter of record for discussion at the 20 November 1986 COR meeting. a. We continue to be concerned with the term "binding" as it is used throughout the issuance documents. Although we are not suggesting a change, it must be understood that CIA's position is that no issuance would be binding where it conflicted with prior statutory or appropriate Executive Order authority. b. We believe that proposed issuance system language grants authority to the Assistant to the President for National Security Affairs (APNSA) which he had not been properly delegated. It is requested, therefore, that the words "a roval b " the APNSA in NCS Directive 1-1, paragraph 8(c) an Appendix A, paragraphs 3 and 4 be changed to read "in consultation with" the APNSA. 2. We further believe that the Issuance System is one of the more important subjects facing the NCS and will support a measured and deliberate approach to establishing these procedures.
