On September 23, 1987, the DOL waived the $10,000 SF 99 reporting threshold in 29 CFR 4.8, thereby permitting a $25,000 threshold to be implemented in the Federal Acquisition Regulation (FAR). The $25,000 threshold is included in the proposed draft of FAR 22.10 currently under consideration by the Civilian and Defense Councils. This CAAC letter provides a copy of the DOL waiver letter of September 23, 1987. Rizzi Chairman Civilian Agency Acquisition Council Office of Acquisition Policy General Services Administration Washington, D, C. 20405 This is in response to your letter of July 24, regarding Standard Form (SF) 99, Notice of Award of Contract. As you indicated in your letter, a major goal of the 1983 revisions to the Service Contract Act (SCA) regulations was to minimize administrative and paperwork burdens for contracting agencies wherever possible, consistent with the effective administration of the statute and without sacrificing data needed by the Wage and Hour Division. Previously, 29 CFR 4.8 provided for contracting agencies to submit SF-99's for every contract awarded that was subject to the SCA (i.e., over $2,500, based on the statutory threshold for including wage determinations in contracts). These forms were used in planning and scheduling enforcement activities under SCA. However, the Wage and Hour Division subsequently arranged with the Federal Procurement Data Center (FPDC) for FPDC to provide quarterly reports from its database showing contract award data sorted according to the geographic jurisdictions of Wage and Hour Division area offices. Contrary to the information contained in your letter, contracting agencies do not submit copies of the SF-279, Individual Contract Action Report, to the Wage and Hour Division. Rather, the SCA regulations were revised at 29 CFR 4.8 to provide that agencies which reported contract awards to FPDC via the SF-279 need no longer submit SF-99's to the Wage and Hour Division, but the SF- 99 reporting requirement continued in effect for contracts over $10,000 for those agencies that did not report to FPDC (unless such agencies made other arrangements for automated reporting of contract awards) . As a result of the increase from $10,000 to $25,000 in the threshold for reporting contract awards to FPDC via the SF-279, we no longer receive useful data on contract actions under $25,000, because the contracting agencies are not now, as a general matter, submitting the SF-99's required by 29 CFR 4 .8 .
