MEMORANDUM FOR: See Distribution 23 January 1981 OLC 81-0109/5 FROM: Chief, Legislation Division, OLC SUBJECT: Title V of the Draft Fiscal Year 1982 Intelligence Authorization Bill 1. In an effort to overcome OGC objections to restructuring Title V as an amendment to the CIA Act, and Office of Finance objections to a statutory link between CIA benefits and the Foreign Service Act, I am proposing the attached subsections 501(a) and (b) as a new (and complete) Title V. 2. As free standing legislation within the Authorization Bill the authority granted in these subsections would be ? permanent. 3. Note that the proposed new 501(a) and (b) would: -- avoid direct amendment of the CIA Act; -- avoid a statutory link with the Foreign Service Act; -- take care of the Community in 501(b) by authorizing entity heads to pay their officers serving under circumstances comparable to CIA officers benefits comparable to those authorized by the DCI under 501(a). This authority would not extend to CIA benefits authorized under the CIA Act. 4. I would appreciate having your comments on this proposal quickly. Attachments ?
