U.S. District Judge Donald O'Brien rejected motions Friday by lawyers for the
Dakota American Indian Movement to delay or move the non-jury trial, said
Assistant U.S. Attorney Reed Rasmussen.
The government wants a court order to evict the 40 to 50 American Indians and
white sympathizers who live in teepees in the isolated camp on U.S. Forest
Service land about 12 miles southwest of Rapid City.
O'Brien, presiding at a closed-door pre-trial conference in St. Paul, Minn.,
ordered the government to inform Yellow Thunder lawyers about any files that may
have been kept on the camp by federal agencies including the FBI, CIA and U.S.
marshal's office.
Rasmussen said the government may turn over some information in the files. If
there is material the government wants kept confidential, it will ask the
judge's permission to withhold it, Rasmussen said.
