This will acknowledge receipt of a letter from a member
of your staff, Mr. H. Todd VanDellen, seeking assistance for
to change a retirement benefit election he
made at the time of his retirement in 1970.
For your background information, rought this
matter to our official attention in 1981 and again in 1983.
Both times the matter was thoroughl reviewed by responsible
and competent Agency managers, and as informed
that nothing could be done to change his irrevocable election
not to provide survivor benefits, even though he was married
at the time of his retirement.
On this third request, we directed that Agency officers
look at request from the perspective of "why
can't his request be honored?" Fund administrators,
attorneys'in our office of General Counsel, and senior
personnel management managers all looked at his request from
the directed viewpoint.
In point of fact, did not elect, at the time
of his retirement, to provide a survivor annuity. His
decision cannot be changed unless the Central Intelligence
Agency Retirement and Disability System (CIARDS) law is
amended. The CIARDS statute is identical to Civil Service
retirement law in this respect. While we would very much
like to assist an Agency annuitant, we do not have the legal
authority to do so., We have attempted to express our sincere
regret to in the past, and again now sincerely
regret that the law does not allow us to accept his request.
