George Director, Office of Legislative Liaison SUBJECT: CIA Activities Under the Provisions of Executive Order 12333 1. Action Requested: It is requested that you sign the attached letter and accompanying memorandum to Representative Boland, Chairman of the House Permanent Select Committee on Intelligence (Tab A). The letter constitutes your affirmation of an agreement, subject to DCI approval, reached between concerned Agency components (DDO, IG, OLL, OGC) and HPSCI staff regarding the parameters of periodic written and oral reports to the HPSCI concerning CIA's activities under the provisions of Executive order 12333. 2. Background: The Chairmen of HPSCI and SSCI have written separate letters (Tab B) to you stating that the Committees want increased Congressional oversight of Executive Order 12333 activities. You responded to both Committee Chairmen stating that their requests would receive the careful attention of senior Agency personnel and that Agency staff would meet with Committee staff to discuss the issues raised (Tab C). 3. Since the receipt of these letters, a series of meetings were held with senior Committee staffers, principally the HPSCI, but neither Committee pursued the matter with much vigor. Recently, however, the HPSCI staff sought to reach a final agreement as soon as possible. Consequently, extensive negotiation took place during the past several weeks between representatives of the office of General Counsel, the Office of Legislative Liaison, the Inspector General's Office, and the Directorate of operations (including John Stein andl 25X1 ), representing the CIA, and Majority and Minority 25X1 Counsels of the HPSCI. As you note, Chairman Boland's letter and your proposed response make clear that the type of written reporting will be along the lines of the FY 83 report enclosed with your proposed letter at Tab A. The written reporting requirements are basically statistical rather than substantive and deal with activities such as undisclosed participation in organizations in the U.S., including a number of organizations in the U.S. used for this purpose. In addition, the agreement calls for general overview of operational activities in the U.S. and abroad, and numbers of cases opened on U.S. persons for foreign intelligence, counterintelligence, narcotics and counterterrorism purposes. 4. A major stumbling block to the agreement had been the extent of the reporting on counterintelligence cases directed at U.S. persons. This matter was finally resolved to all our satisfaction an oral briefing of the HPSCI Chief Counsel by in which he provided a 25X1 detailed generic description of types of counter- intelligence cases involving U.S. persons plus a general description of specific cases, which was given in such a manner as to protect the sensitivity of these cases. The remaining areas about which we agree to report orally conform to existing practices or previous commitments. 5. Recommendation: That you sign the letter and accompanying memorandum to Chairman Boland attached at Tab A. Clair E. As stated in your letter, the agreement as to written reporting is based on the understanding that the nature of the written reporting will be along the lines of the FY 83 report, the final version of which is enclosed herewith.
