SUBJECT: House Passage of H.R. 1524
1. Attached for your information are copies of pages
H 1033 through H 1070 from the Congressional Record of
March 12, 1986. They reflect House consideration and passage
of H.R. 1524, the "Employee Polygraph Protection Act of
1985 (6)".
2. The amendment in the nature of a substitute,
(essentially H.R. 3916) offered by Representative Young which,
you will recall, was the subject of earlier memoranda from this
Office, was defeated by a recorded vote of 173 to 241
(p. H 1056).
3. As per his original commitment to the Agency,
Representative Williams, the sponsor of the bill, did offer in
his initial package of "technical amendments" the changes which
the Agency had sought to protect its equities. The package,
including the Agency's amendment, was adopted without
controversy (pp. H 1057-1058).
4. The action now moves to the Senate where the Senate
Labor and Human Resource Committee,, chaired by Senator Hatch,
is scheduled to hold hearings on S. 1815 on April 23, 1986.
5. In light of continuing opposition by the Department of
Labor, the Office of Management and Budget (0118) still has not
cleared the views letter of the Department of Justice letter on
H.R. 1524 and S. 1815 and it is questionable whether or not the
letter will ever be cleared. Justice is, therefore, now
attempting to be invited to testify at the Hatch hearings on S.
1815. This means that the Labor-Justice struggle will now
focus on Administration/OMB clearance of the Justice testimony,
with Labor likely to object to any statements in that testimony
which indicate outright opposition to the legislation.

6. We will keep you advised of developments. In the
meantime, we intend to discus informally with members of
Senator Eatch's labor committee staff the Agency's concerns
vis a vis S. 1815.
