Portal-to-Portal bill ( H.R. 3614 )/ Proposed
"Intelligence" Amendments
1.
By
legislative referral memorandum of 10 June 1986, the
Office
of
Management and Budget asked for our review and
comment on
the above described amendments.
2. While it would appear that these amendments answer some
of our concerns about the impact of the bill on operations, the
amendments are unacceptable because they fail to revive section
8 authority. In addition one of the amendments would impose
onerous record keeping requirements, also having the potential
for disclosure of sensitive material. Another harmful
amendment narrows the definition of the "field work
exemption."
4. Apparently, the White House is attempting to move the
bill as evidenced by recent contact with staff persons on the
Senate Governmental Affairs Committee.
5. I contacted John Logan at the Department of Justice who
said that he had the same fundamental problems with the
proposed amendments as we did. It was his opinion that the
White House would attempt to take advantage of the chaos during
the last two weeks of Congress and try to slip the bill
through. As of this writing Senators Durenberger, Goldwater,
Stevens and Denton had holds on the bill in behalf of various
federal agencies.
6. I conveyed our position on the bill to Greg Jones at
OMB on these anemdments on 11 June 1986.
