1986 Act, gave the Agency access to such records but required
the submission of the subject's fingerprints under certain
circur-::stances.
Since enactment of this provision, the only State or
locality requiring the submission of fingerprint cards for
criminal'histcry record information has been the State of
California. The Agency ceased submitting. such requests to the
State of California since information formerly received from
the State Repository can be obtained from local jurisdictions.
To date, no other State or local jurisdiction has required: the
Agency to submit fingerprint cards for this information.
In summary, the requirement to submit fingerprint cards to
State or local. jurisdictions for criminal history record
information under this provision has had little to no effect on
the Agency's ability to obtain this information.

SUBJECT: Access to Criminal History Record Information
for National Security Purposes - Effect of the
Fingerprint Submission Requirement to State or
Local Jurisdictions
1. In compliance with the Intelligence Authorization Act
for Fiscal Year 1986, Public Law 99-169, Section 9101, Criminal
History. Record Information for National Security Purposes, this
memorandum provides. information for the "one-time" report
.required by Congress on the effect of the fingerprint
submission requirement to State or local jurisdictions.
2. Since Congress enacted 5 U.S.C. Section 9101, the only
State or local jurisdiction requiring the submission of
fingerprint cards for criminal history record information has
been the State of California. The Office of Security ceased
submitting such requests to the State of California since
.information formerly received from the State repository can be
obtained from local jurisdictions. To date, no other State or
local jurisdiction has required us to submit fingerprint cards
for this information.
3. In summary, the requirement to submit fingerprint cards
to State or local jurisdictions for criminal history record
information under Public Law 99-169, Section 9101, has had
little to no effect on our ability to obtain this information.
