FERS/2nd Chance Proposal:
"No Oldtimers Section"
STATUTE: Section 402 (c). The amendment made by this
section shall be effective only as to designations made after 1
January 1988. The six month period referred to in Section 301
(d) shall begin on the date of enactment of this Act in the
case of any designation after 1 January 1988 but prior to the
date of enactment of this Act.
REPORT LANGUAGE: Subsection (c) of Section 402 will insure
that the "second chance" created by Section 402 is open only to
persons designated after January 1988, the close of the FERS
"election" period. For persons designated after that date but
before Section 402 is enactee into law, the six months "second
chance" election period begins to run on the date Section 402
is enacted into law. For persons designated thereafter, the
six month period runs from the date of designation.
