Director for Legislative Affairs) will serve as point of contact for ccntacts with the SSCI. Barry Kelly (Senior Director for Intelligence Programs) will coordinate substan- tive positions and testimony. All requests from SSCI for agency representatives to discuss pending intelligence legislation should be coordinated with Alison Fortier. (C) State, DOD, JCS and FBI should review S. 1721 and provide the PCG with a full assessment of their views, including Legal views, regarding the implications of this legislati9n for the intelligence community. If appropriate, they shedld also comment on constitutional issues raised by the legisla- tion. Justice and CIA are requested to review the informa- tion they have provided already to determine whether it requires revision. Analyses should be provided to the NSC by COB Friday, November 27. (C) It was agreed that the Administration should request testi- mony by senior level witnesses before the SSCI on S. 1721. Siecretary Carlucci is prepared to testify. State and Justice are requested to inform the NSC whether Secretary Shultz and Attorney General Meese can be available or whether another senior official will represent these agencies. When witnesses are confirmed, the NSC will advise SACI of their availability. (C) The NSC staff will draw up and coordinate a list of proposed outside witnesses the Administration would suggest testify op S. 1721. Agency suggestions for this list should be provided to Alison Fortier by COB Wednesday, November 25.
