MEMORANDUM FOR: GSA Project Manager
Chief, New Building Project Office, OL
1. On 2 April 1987, the Agency Inspector General (IG) advised me that
he had received a telephone call from one of our site security monitors
regarding soil erosion and sediment control on our New Headquarters
Building (NHB) site. Specifically, the secuirity monitor alleged that
there is inadequate control of sediment flowing from the site into the
Chesapeake Bay via the Potomac River. On 3 April, I discussed the matter
with you and asked for the following information:
a. Federal, State, and/or local laws/regulations that
apply to our construction site,
b. Applicable requirements contained in our contract with
the prime contractor, CENTEX,
c. Actions taken by the contractor to meet contract
requirements, and
d. Additonal actions, if any, required to meet the
requirements.
2. As of 20 April, I had not received a satisfactory response to my
request for information. My impression from three discussions with you
relating to this matter is that while you are not fully aware of what the
Federal, State, and/or local requirements are, you believe that CENTEX is
not in compliance with contract requirements. Since I was contacted by the
IG, I have noted the presence of soil erosion and sediment control measures
on other construction sites (the Rt. 123 offsite road work and on I-495 in
Montgomenry County) and the lack of substantial measures on our site.
Clearly, we must take aggressive action to ensure compliance with the
spirit of applicable laws/regulations. And, I personaly must respond to
the allegations of the security monitor and, if appropriate, demonstrate
that required corrective action has been/is being taken.
3. In this regard, I need a definitive response to the issues listed
in paragraph 1, above. I would prefer to handle this issue internally;
i.e., within the Agency, GSA, and CENTEX. However, if necessary, I am

prepared to request assistance from appropriate Federal, Fairfax County,
and/or State of Virgins officials to determine what we should be and what
we are doing with respect to soil erosion and sediment control. Please
increase your efforts in this regard so that you can provide me the
information I require, in writing, by COB 28 April 1987.
