H.R. 8202 proposes to add a new Section 405 to the Federal Property and Administrative Services Act of 1949, the purpose of which is to permit "the head of each executive agency" to "donate without cost for use in a foreign country for educational or health purposes any foreign excess property held by such agency which he determines is suitable for use for such purposes to any nonprofit, charitable, or eleemosynary private organization which carries on health or educational activities in such foreign country and is in need of such property for carrying on such activities." Overall policy control of this-program is to be established by the Secretary of State. 2. In my opinion this Bill is unobjectionable insofar as its effect on this Agency is concerned. I would call your attention specifically, however, to the possibility which this Bill would seem to offer for the use of foreign excess property held by this Agency in support of appropriate operational activities conducted by this Agency overseas.
