Attached for your information are lists of Federal, State and Local participants who will be attending the two days of hearings before Senator Jeremiah Denton's Senate Judiciary Security and Terrorism Subcommittee on 13 and 14 September. The FBI is currently completing the clearance process on those State and Local participants who do not possess a Top Secret clearance. The Bureau has assured Subcommittee staff that there is sufficient time and that the process will be completed by Tuesday. Subcommittee staff informs the undersigned that there may be as many as 70 individuals participating in the two-day closed session. 2. The session will take place in the Senate Judiciary Committee Hearing Room, 2226 Dirksen Senate Office Building. Transportation leaves the front of Headquarters at 9:15 a.m. on the 13th. Please inform the undersigned should there be additional CIA participants. We must relay the same to Subcommittee staff to insure admittance on 13 and 14 Sep- tember. Security for the hearing is being provided by the Capitol Hill Police (Detective Jarboe, tel. 224-3171, Special Investigation Division). The Capitol Hill Police will post two uniformed policeman at the door and provide sweep and monitoring services throughout the hearing. In order to be fully prepared for the session, we have set up a prebrief to be held on Monday 12 September at 11:00 a.m. in Room 6E 60 Headquarters. Office of General Counsel will send a representative to brief on the parameters of CIA's role domestically especially as it relates to the subject matter of this hearing. Office of General Counsel will provide CIA's witness with a one page talking points paper should the issue be raised. 4. Subcommittee staff advises that FBI/CIA/NSA panel may be testifying longer than most of the other witnesses simply because the Senators consider the Federal link in the Olympic Security chain to be particularly important. According to the staff, the line of questioning may be as follows: -What is CIA's specific role in the area of Olympic Security? -Are the normal collection criteria sufficient to satisfy this special need? -Is there a need to increase collection coverage for the Olympics? -What is the intelligence apparatus that is (will be) set up to cover this issue (describe)? -Is there a mechanism established to get the intelligence to the State and Local authorities should that be necessary for them to act on it? -What problems might arise/recommendations we might make to insure the best security possible? 4. The CIA witness may wish to address some of these issues in his opening statement. This office recommends that the CIA witness deliver a brief opening statement touching on these areas and leave specific details to be covered during the question and answer session. While we do not have to submit an opening statement, we should be prepared to make one as a member of the panel. The purpose of the meeting, initiated by the under- signed, was to establish the parameters of testimony to be given during hearings to be held by the Subcommittee in mid-September (see Reference). Lisker and Milling, Mr. John Podesta, Minority Chief Counsel, will also be present; o CIA witness should be a "working level" individual who can speak authoritatively on terrorism reporting. The witness should be prepared to speak--at the Secret level--as to the mechanism that exists for reporting possible terrorist attempts to the FBI and explain the Executive Order limitations that restrict Agency action within the U.S.; o it will not be necessary for the CIA witness to submit a written statement; o Subcommittee staff will make efforts to group all Administration witnesses (FBI, NSA, CIA, DOD, Secret Service) on'the same day and possibly as a panel; and, o Efforts are being made by the Sub- committee staff to,identify clearances of those outside the Administration who may be present during the testimony,. viz., other witnesses. Staff was informed that access will clearly be dictated by verified security clearances. 3. We have been informed that the 13 September Olympic Security Hearing before Senator Denton's Senate Judiciary Security and Terrorism Subcommittee will begin at 10:00 a.m. and last until 4:00 p.m. It will begin promptly at 10:00 a.m.-with a fifteen minute overview to be provided by a representative from the Los . Angeles Police Department. Following the introduction, the White House representative will testify and thereafter seriatim the other witnesses listed in reference c. 2. Senator Denton has specifically requested that all witnesses plan to be present for the entire session both days. This, according to staffer Bert Milling, will provide for the desired interaction of federal and local authorities, who, perforce, may have to work together throughout the time prior to the opening of the Olympics in 1984. Accordingly, the CIA witness or his representatives should block out the appropriate time. Additionally, Senator Denton intends to have a wrap-up session at the end of the second day for witnesses who have already testified to add whatever they thirik may be appropriate, having had the benefit of hearing other witnesses'. testimony during the two-day session. 3.
