MEMORANDUM FOR: Deputy Director for Operations

SUBJECT: SSCI Harper Case Hearings
1. On 19 October the SSCI sent letters (attached) to the
Attorney General and the Director, FBI asking for briefings on the
Harper case on 2 November. Key issues to be considered at the
briefing are (1) a preliminary damage assessment and (2) more
important, how our interagency counterintelligence coordination
worked on this case.
2. Concerning coordination, the SSCI staff has "suggested"
to us that CIA should appear at these hearings, remembering that
the FBI public arrest affidavit for Harper mentions that a CIA
penetration of the Polish service played a role in this case.
3. If you want to avoid appearing at these 2 November
hearings, we suggest that you, together with an appropriate FBI
officer (we would recommend Edward O'Malley, Assistant Director,
Intelligence Division), personally brief Senators Goldwater and
Moynihan. If you agree, we will set up the briefing to suit your
schedule.

-On October 15, 1983, the Federal Bureau of Investigation arrested
James Durward Harper, Jr., after a federal complaint was filed in
San Francisco charging him with espionage. It is our understanding
that Harper allegedly received in excess of $250,000 for classified
national defense information which he sold to Polish~-intelligence'== -
officers abroad. Obviously, this'-is a case of high interest to
our Committee.
Therefore, we would like to invite you or your representative to
brief the Committee on this case in the near future. We are
particularly interested to know how the inter-agency counter-
intelligence coordination mechanisms operated in this case. As
well, we would like to receive a preliminary damage assessment.
We are'asking representatives of other agencies involved, such as
relevant components of the Department of Defense, to participate in
this briefing. Members of our staff will be available to consult
with your representatives on the appropriate format for the briefing.
The briefing before the Select Committee is scheduled for Wednesday,
November 2, 1983, at 2:00 p.m., in Room S-407 of the Capitol. In
preparation for this briefing, please provide all relevant information
to Committee staff representatives as soon as possible.
