SUBJECT: HFAC Markup of the Foreign Assistance Act.
On May 1, 1989, the Department of State provided the House
Foreign Affairs Committee (HFAC) with the Administration's
(1) International Security and Development Cooperation Act
of 1989 and (2) comments on the HFAC March 17th Discussion
Draft that is the "Proposed Implementation of Most
Recommendations of the House Foreign Affairs Committee's
Task Force on Foreign Assistance." Administration
comments on title II (military assistance) of the
Discussion Draft were provided to HFAC in a separate State
Department report in March 1989. Taken together these
three documents (attached) represent the Administration's
position on the reauthorization and reform of the Foreign
Assistance Act.

Subsequently, the Agency for International Development has
provided this Office with copies of six HFAC subcommittee
prints (attached). These will be considered when HFAC
begins markup of the Discussion Draft, probably the week
of May 8th. Based on a cursory review, the subcommittee
prints appear to contain numerous congressional earmarks
and other types of objectionable legislative
micromanagement provisions. Administration opposition to
these types of provisions has been clearly communicated to
HFAC through both formal and informal channels.
The subcommittee prints are informal documents, and we are
not currently seeking formal comments from your agency.
However, they are being provided (1) to allow agencies an
opportunity to review provisions that may affect them, and
subsequently, (2) to facilitate the development of
Administration positions. For the near term it would be
helpful if agencies could advise this Office of any
specific provisions that they believe would improve the
operation of the programs that the provisions affect.
The Office of Management and Budget requests the views of your
agency on the above subject before advising on its relationship
to the program of the President, in accordance with OMB Circular
A-19.
