SUBJECT: Hotel and Motel Fire Safety Act of 1989,
H.R. 94
1. On 12 April 1989, the House Science Research and
Technology Subcommittee of the Committee on Science, Space and
Technology marked up the above-captioned bill. The bill is
aimed at the providing of safeguards against fire, i.e.
automatic sprinklers and smoke detectors, within the hotel
industry. Section 5 would, in most instances, proscribe
payment of per diem to employees not staying at public
accommodations meeting Federal fire prevention and control
guidelines. Attached is a copy of the bill for your review.

.AUNDMENT IN THE NATURE OF A SUBSTITUTE To H.R.-94
OFFERED BY MR. BoEHLERT
Strike all after the enacting clause and insert the
following:
1 SECTION 1. SHORT TITLE.
2 This Act may be cited as the �Hotel and Motel Fire
3 Safety Act of 1989- .
4 SEC. 2. FINDINGS AND PURPOSE.
5 (a) FINDINGS.--Congress finds that--
6 (1) more than 400 Americans have lost their lives in
7 . multistory hotel fires over the last 5 years;
8 (2) when properly installed and maintained, automatic
9 sprinklers and smoke detectors provide the most effective
10 safeguards against the loss of life and property from
11 fire;
12 (3) some State and local governments and the hotel
13 industry need to act more rapidly to require the
14 installation and use of automatic sprinkler systems in
15 hotels; and
16 (4) through the United States Fire Administration and
17 the Center for Fire Research, the Federal Government has
18 helped to develop and promote the use of residential
19 sprinkler systems and other means of fire prevention and
20 control.
