SUBJECT: H.R. 2536 - Amendment to the Federal Tort
Claims Act
1. Attached for your information is a copy of
H.R. 2536, an amendment to the Federal Tort Claims Act
which was introduced by Representative Owens on
1 June 1989. As you will note, the bill narrows the
discretionary function exception to the Federal Tort
Claims Act by limiting that exception to situations where
the discretionary function involves policy formulation.
2. While it is appears unlikely that this bill will
go very far, we will continue to monitor it and keep you
informed.
