SUBJECT: DOJ Report on Legislation Affecting Diversity
Jurisdiction of the Federal Courts
1. Attached for your review and comment is a Department of
Justice (DOJ) letter to the House Judiciary Committee on five
related bills -- H.R. 3689, 3690, 3691, 3692, and 3693 -- that
would abolish or otherwise modify diversity jurisdiction of the
federal courts. The Office of Management and Budget has
requested the views of our Agency on this DOJ letter by Friday,
4 May 1984.
2. DOJ supports H.R. 3689, the till that would completely
abolish diversity jurisdiction in the federal courts, without
qualification. DOJ also supports the enactment of the general
types of reforms contained in the other bills as preferable
alternatives to current diversity jurisdiction.
