Douglas joined'. ?.:'Members the Crescenta-Can- ada Democratic Club of Los An- geles County, Calif., had asked the court -to rule that. they could sue five men, accused Of breaking up a club meeting held Nov. 14,1947, at La' Crescenta, for $25,000 damages. Club' members said outsiders raided the .meeting after learning that a resolution approving,: the Marshall Plan for European recov- ery was likely to be adopted. The suit Was filed under, a sec:- tion of the post-Civil War Civil . Rights Act; The section provides that if two or more persons con- spire to deprive any person or class of persons -of any right or privilege as a citizen, the injured . person may sue for damages. The District Court threw out the snit but the Circuit Court in San Francisco reinstated it. The five- men sued by club members then appealed to the Supreme Court.
