MEMORANDUM FOR: Deputy Director (Plans)

SUBJECT : Patent Rights
1, You will note in the attached papers that we have run head-
long into a patent rights problem in one of the first contracts which
we have attempted to negotiate for the Program. We are try- 25X1A
ing to compromise with the contractor to ge this contract on the
road. However, I anticipate . future problems of a similar nature in
connection with this Program.
2. Whine I believe that the Deputy Director (administration)
should be responsible for protecting the Government's interest in
these matters, I would hope that we could all agree on what Agency
policy should be. I concur in the General Counsel's suggestions, which
are attached, with the exception of paragraph 3. c. thereof. The
Agency Patents Board was set up for an entirely different purpose and
were I the Deputy Director (Administration) I would like to reserve
the right to make final determination myself. I. therefore, would
place the responsibility for final determination on the Deputy Direc-
tor (Administration) who, of course, could consult others in the Agency,
including the Patents Board, if he deemed it appropriate.
3. I would appreciate receiving your comments on this matter as
early as possible,
