Talked with Bernard Fensterwald, Chief Counsel, Subcommittee on Administrative Practice and Procedure of Senate Committee on Judiciary, about the status of wiretapping legislation. He advised that in fact Senator McClellan's bill, S. 675, is being attached to an already passed House bill on aid to State law enforcement agencies which bill is an Administration-sponsored bill. Fensterwald also advised that Senator Hart is very seriously considering pushing for a judicial procedure for all wiretapping indicating that he specifically had in mind the national security exemptions. Further, McClellan's bill does not have the language on national security which was worked out by Justice, CIA, NSA and the Subcommittee. I also reviewed this situation with Larry Conrad who also sat in on the last meeting of the Subcommittee involving this situation. He was of the view that Senator Hart's proposal did not go to the national security exemption but rather to the organized crime situation.. He has promised to take this up with Senator Birch Bayh with the thought that Bayh would inquire as to Senator Hart's views. about S. 1035. He is fully familiar with its implications and regretted that he was away when Katzenbach requested some assistance from Meeker. He indicated that this was a matter which State felt very strongly about, adding that they had planned to focus their efforts in the House. He will check with the Bureau of the Budget so that they can make a contribution to the over-all Government position. Also discussed with Mr. Lyerly the Gross amendment in terms of the nearly completed negotiations with the Cypriot government. He was familiar with the Cypriot negotiations of course but was unaware of the Gross amendment. However, his office would handle the question of Presidential waiver and I alerted him to the necessity of protecting our share of the Cypriot payment in securing such a waiver since reports are required on such waivers to the Congress. 10. Met with James Kendall, Colonel Harper and Colonel Glenn Smith, Senate Preparedness Investigating Subcommittee staff, and signed them up for the various special clearances so that now all have the same clearances.
