FOR DC USE ONLY SUBJECT: $xchange of Patent Materials TO: The American &ibassy, MOSCOW Reference is made to the Embassy's despatch 204, October 6, transmitting the Soviet reply on proposals for a U.S.- U.S.S.R. exchange of patent materials. Under separate cover a copy of the U.S. Patent Office Classification Manual is being sent to the Embassy, as requested, for transmittal to Mr. Zubov. The U.S. Patent Office and the Department are satisfied with the terms of the exchange of patent materials as set forth in the referenced despatch. The Department is of the view that the exchange should not be made the subject of a formal agreement, but should take place in the same manner, on the technical level,'that has been used by the Patent Office for exchanges with the patent authorities of other countries. However, the Embassy may, if it considers it useful and appropriate, transmit a note to the Soviet Ministry of Foreign Affairs informing it of the willingness of the U.S. Patent Office to carry out the proposed exchange. The note should not be drafted in such a manner that it will constitute an agreement between the two governments. The Embassy is requested to meet again with Mr. Zubov and to advise him that the U.S. Patent Office suggests that the exchange begin with materials issued on and after January 1, 1959- If it is also desired by the Soviet Ali-Union Patent-Technical Library to exchange 1958 materials, arrangements can later be made for such an exchange. On the U.S. side the physical exchange will be made by the Smithsonian Institution, International Exchange Service, 10th and Independence Avenue, S.4., Washington, D.C., which will send the U.S. materials to the Soviet Library and will receive the Soviet materials. The Embassy is requested to advise the Department of the recipient in Moscow of the American materials.
