SE Division, I called Dale De Haan, Counsel, Senate
Judiciary Subcoommitt , on Refugees and Escapees, to inquire as to
reactions to visit with him on Wednesday. Dc Haan said
as firm y persuasive zn his request but did not appear to be emotional or
s ow any signs of irrational conduct. Though their office reviews a large
number of requests for assistance, De Haan stated that he was concerned as
to the harsh treatment which0 wife has been given. by the

Counsel, Senate Government Operations Subcommittee on Intergovernmental
Relations, and informed him that a decision had not yet been made as to
whether the Director would accept the invitation of the Subcommittee to
testify on 3 October on the subject of congressional access to executive
information. I told him a decision should be made by early next week. He
stated that Senator Frank Church (D. , Idaho), Chairman, Senate Select
Committee, will testify but it is not clear at this time whether Representative
Otis G. Pike (D., N. Y.) Chairman, House Select Committee, will also appear.
5? PLC) THIRD AGENCY Mr. Eireich, Associate
Director for Communications and Data Information, GAO, called. GAO is
reviewing the security of a new ADP computer system for the Internal Revenue
Service. The' system. is vulnerable to compromise and GAO must determine
whether it should be.encrypted. He had checked with NSA and FBI as to whether
they were. aware of any cases whereby a system has been compromised through
the intecept of magnetic radiation or on-.line tapping., Bothagencies were negative

OMB, and in response to my query, he stated that an Administration position
had not yet been formulated on S. 2170. I told him that a decision had not yet
been made as to whether the Director would accept the invitation to testify on
3 October )efore the Senate Government Operations Subcommittee on
Intergovernmental Relations, on the bill. He asked that we clear the Director's
statement with them prior to his appearance if he agrees to testify.

12. - RC) INTELLIGENCE BRIEFING Accompanied
OE R, to a briefing of Howard Feldman, Dorothy Fosdick
and Stuart Statler, on the staff of the Senate Government Operations
Permanent Subcommittee on Investigations, which consisted of an update
of the Soviet grain situation. The focus was on the Soviet's shortfall and
what options they have elected to exercise. The ability of Soviet ports to
handle grain imports was also discussed.
13. - RC) HEARINGS Returned a call from Thomas
Susman, Chief Counsel, Senate Judiciary Subcommittee on Administrative
Practice and Procedure, in which he set up 10:00 a. m. on Tuesday, 23
September, for an informal discussion of on-going Agency behavioral
testing programs with the understanding that we should be prepared to
cover 1970-1975 activities. Susman did not want to be pinned down to that
cut-off date as he felt that some understanding of earlier periods might be
required to give meaning to our on-going activities. I said let's stick to
the 5-year period and if questions come up which need some research into
the 1960's, we will negotiate. He again asked me about the. other three
questions (Lexington, Boston, and Dr. Abramson) and I told him I
thought that would predate 1970. I then asked him what lie was trying to
find out. In sum, he said he was interested in not only what we did in
this field, but how we went about doing it. He mentioned that he had
evidence that and Gischekter Fund were acting as
intermediaries for the Agency in this field. In fact, he had a telegram
from Dr. Abramson which indicated that the Gischekter Fund was the
source of monies for his research for the Agency. I said if that is all
you want to find out, we can take care of this matter quickly.
14. I F PLC) LIAISON Jim Davidson, Counsel, Senate
Government operations subcommittee on Intergovernmental. Relations, called
and asked as to whether the Director would be accepting the Subcommittee's
invitation to testify on the hearings concerning the "Congressional Right to
Information Act" (S. 2170), tentatively set for 29 September and 3 October.
I explained that we had not yet heard from OMB. He asked if I would call
him tomorrow if a decision has not yet been made. He added that the Director
could send a representative rather than appear himself. He also added that
the Committee would be looking into S. 3393, another bill on furnishing infor-
mation on the Congress and indicated that the Agency would be asked for
comments.

Rourke, who works for John O. Marsh, Counsellor to the President,
Rourke said Marsh was preparing a paper which he would have to submit
to the President by 5:00 p. m. on certain aspects of the House Select
Committee situation and said they are trying to locate any material on the
subject of the historical development of the handling of classified material
with the Congress. I told Rourke I was not certain we had any papers
on the topic as he had described it but I would check and let himnn. know.
I called Rourke later and told him we had two documents (a memo
prepared by the General Counsel on 11 April 1975 on this subject and
another blind memo prepared in connection with the House Select Committee
confrontation) which I LDX'd to him as being of possible interest.

Practice and Procedure, for copies of the material provided

family, John_Greaney, OGC, reported he talked with
attorneys for thel about this request and aske Their view about
our providing this ma e.rial to the Subcommittee. The firm has taken the
position that they would like us to withhold transmittal of this material. to
Subcommittee until they have had an opportunity to further consider it.
Greaney suggested that if we are pressed further by the Subcommittee staff,
we should indicate we are withholding this material at the request of the
family and they may wish to contact the family directly.
10. THIRD AGENCY Spoke with Mike Oppenheime
GAO, requesting clarification of the term "intelligence committee" referred to
in the Staats letter regarding the Mayaguez. He said it referred to the intelli-
gence committee of the NSC. He asked how we were coming on the answer. I
told him we were actively working on the matter and hoped to have some sort
of answer in the next day or so. He reiterated his offer to sit down and discuss
the request if that would be of help.
11. I ITHW) BRIEFING Ricki Starrels, Appointment
secretary for Representative Bill Archer (R. , Tex. ), called to request a
change in the time for the debriefing of the Representative. She said he
would like to hold the debriefing during lunch and that they would be happy to
provide sandwiches in his office. I checked with I lwho verified
12:00 nocn on the 23rd. as a time for the debriefing and stated there mould be
three be., ides myself in attendance. I called Ricki Starrels back and confirmed
the time and told her that we would appreciate the provision of sandw.che> but:

15. (Unclassified - RC) INTELLIGENCE BRIEFING Accompanied
Ted Shackley, C/EA, to a briefing of Representative Lester Wolff (D. , N. Y. )
on a question he had left with the DCI on opium traffic in the Tri--border
area. Shackley discussed the Shan State Army and the Shan United Army and
their role in open smuggling as well as the drawdown of ChiNat forces in
the area. Shackley also mentioned that we had information similar to the
Congressman's info on the 4 or 6 tons of opium which might be coming down
the trail. Mr. Wolff said he did not favor pre -exemption buying by the U. S.
Government and only wanted to pass the information on to the Agency as he has
done in the past. Shackley also took this occasion to deny any Agency
support to resistance groups in and around Burma. This should close out
Mr. Wolff's request by letter to OLC. Mr. Wolff said he was a supporter
of the Agency and felt that, the only solid information he gets from the Government
on these kinds of matters is from the Agency. He felt that the current public
discussion of CIA's covert action activities was harmful to the Agency's
collection capabilities. He noted he was against police brutality in New
York, but he was not about to suggest that all the cops be fired. He had
another letter' on the Shan situation which he said he will send to the Agency
for our information.

Chief, Counsel, House Armed Services Committee, a blind memo dated
11 April 1975 prepared by John Warner, General Counsel, concerning the
historical background and authorities of congressional access to executive
information. This was in response to Slatinshek's earlier, call for any background
information on the problem now being faced by the Agency with the House
Select Committee. I also left with Slatinshek a copy of Chairman Otis G. Pike's
(D. , N. Y.), House Select Committee on Intelligence, letter to the President
dated 17 September in response to the President's request for the retu_-n of
classified information previously provided to the Committee..

13. RC) LIAISON Took a call from
James Michie, Investigator, and Thomas Susman, Chief Counsel,
Senate Judiciary Subcommittee on Administrative Practice and Procedure,
who aske fora response to their request for information on the hospital
in Boston and Lexington, and Dr. Abramson, in connection with drug
experimentation. I said it was my understanding that this information was
history and it was being looked into by the Senate Select Committee. Further,
that the principals involved had concluded that to be the case. The Agency was
prepared to cooperate with Susman's Committee on on-going programs 25X1A
going back as far as 1970, and in fact. had told Walter Sheridan, also of
that Subcommittee, that we would come down and brief him whenever he
is ready. Susman thought the understanding dealt only with the
case and not the other questions he had asked and that the Senate Select
resolution is not an exclusive one. I said that the information he wants 25X1A
dates back to the same period as the Icase and that I was not disagreeing
with him on the Senate Select resolution I simply would like him to sort
out who should investigate what and in what time frame. He said he will
take that ball. and I will stand ready to come down on their call and brief
them on on-going programs by my understanding with Sheridan.. 25X1A
(Comment: Have since checked with John Warner, OGC, and
SC/DCI, and found that we cannot use the Senate Select Committee to hide
behind our refusal to answer the Committee's requests in any time frame.
In any event, I will let the matter stand and let Susman call me back and
tell me I am wrong.)
14. - RC) THIRD AGENCY Called Les Janka, NSC
staff, and a vase him that there was not very much we could do to assist
his efforts. He should be aware that we have provided considerable
intelligence support to Ambassador Moore in formulating the Government's
position in this matter. He said he fully understood and really did not
expect anything from CIA at this time, but, perhaps later. His main.
pitch was to some of the other principals around the table. . I did mention
that at some later date, should it be helpful, the Agency could provide
intelligence briefings to certain key members of Congress on the foreign
intelligence of our unilateral action. (Mr. Janka had levied a request
upon all of the representatives who attended the LIG meeting on Friday,
12 September, for them tD call him today with any suggestions they may
have regarding the 200-Iviile Fishing Legislation which was the topic of
the meeting. )

unclassified figures stressing the need for non-attribution.
14. DFM) LIAISON Called Chuck Snodgrass,
House Committee on Appropriations staff, at I request to give
him the details of the Director's news conference, which I attended.
Snodgrass seemed sympathetic to the Director's position in the dispute
with the House Select Committee, and asked for a transcript of the news
conference. I told him I believed one would be prepared and that we would
have one for him next week.

Subcommittee on Constitutional Rights, called to inform me that:
the Director would be receiving from the Subcommittee a request for inform-na.-
tion regarding the Agency's relationship with the Office of Emergency
Preparedness. This request was in connection with the series of joint
hearings that Senator John Tunney's (D., Calif.) Commerce and Judiciary
Subcommittees have been holding on electronic surveillance technology.

20.1 ~ - PLC) THIRD AGENCY Called Charles
Hinkle, FOI Coordinator, Department of Defense, and requested clarification
of Defense's position in, forwarding to the Agency a request from Representative
Charles Thone (R., Neb. ), on behalf of a constituent for the "Special. Collection"
of The Penkovskiy Papers. I subsequently received a call from Major
Hill, of Hinkle's staff, who informed me that he had checked with DIA and
Defense's Office of General Counsel, and determined that the "Special
Collection" was clearly the responsibility of CIA. Hill was aware of the
Ashbrook decision in 1972 upholding the decision of the Secretary of Defense
that the information was classified and could not be disclosed under the
exemptions provided under the Freedom of Information Act. I confirmed to
Hill that the Agency had. re-examined the material and we will inform Mr.
Thone that it is still classified and exempt under the provisions of the Freedom
of Information Act.
