SUBJECT: Uniform Secrecy Agreement

1. At the 10 December 1979 meeting of the working group
on secrecy agreements, we considered a draft variation on the
proposed strawman I had earlier offered. Attached for your
consideration is a. new strawman incorporating language on the
government's authority to evoke acces 0used on adverse data
reflecting on a subject or'for any re,aso- , adding language
indicating awareness of rules and regulations on handling and
storing SCI, and making various editorial changes.
2. I request that you be prepared to discuss the attached
version at our next working group meeting, with a view towards
agreement on a draft for submission to the Compartmentation
Subcommittee.

SECRECY AGREEMENT
SENSITIVE COMPARTMENTED INFORMATION

signing this agreement acknowledge that I have been told about
and given access to certain classified information and intel-
ligence sources and methods which was explained to me to be
"Sensitive Compartmented Information" and which is known by
the term(s) At other places in this agreement

2. I have been told that if this Sensitive Compartmented
Information becomes known to people who are not permitted by
the United States Government to have it, this could cause
:serious harm to the United States of America.
3. I have been told about the steps I must take to
handle and store this Sensitive Compartmented Information.
I have also been told how to find out which people I can show
or talk to about this Sensitive Compartmented Information.
4. In return for being given access to this Sensitive
Compartmented Information, I agree that I will never reveal
this inforn~'It.ion, in any way, to any person who is not permitted
by the United States Government to have it.

5. I also agree to submit for review by the United Govern-
ment, any information concerning intelligence subjects or
activities which .1 want to publish or speak about. I agree to
let the government review this information before I talk
about it or show it to anyone who is not permitted to have
this Sensitive Compartmented Information. I will not publish
or speak about the information until I get written permission
from the government to do so. I understand that the reason
for the government's review of this information which I want
to publish or speak about is to be sure that it does not contain
any of this Sensitive Compartmented Information.
6. If I threaten to reveal this Sensitive Compartmented
Information without permission, I understand and agree that the
United States Government can ask for the assistance of the
courts to keep me from doing so.
7. I understand that if I reveal this Sensitive Compartmented
Information to anyone who is not permitted to have it, I may
no longer be permitted to have access to the information myself
and I may be required to return any of the information. which
I have. I also understand that if I do anything or behave in
a way which shows that I might not be willing or able to protect
Sensitive Compartmented Information, the government may take
away my access to it and require nie to return any of the
information which I then have. I have been told that the

government may take away my access at any time it judges such
action to be in the best interest of national security. I
have also been told the government may do this without giving
me notice or holding a hearing.
8. Also, I understand that if I reveal this Sensitive
Compartmented Information to people who are not permitted to
have it this might violate the civil and criminal laws of the
United States. I understand that a violation of civil law
might cause me to have to pay the cost of any damage which
resulted from my action. I understand that a violation of
criminal law could result in my being fined or imprisoned or
perhaps both.
9. If the United States Government sues me because I
may have violated the civil laws, I agree that the law of the
Commonwealth of Virginia shall apply in interpreting this
agreement. I understand that if the United States Government
sues me for this reason, it can do so in several different
court locations in the United States. I also understand that
I may have to pay the court costs and lawyer's fees which the
Government had to spend in suing me, if I lose the case.
10. If I reveal this Sensitive Compartmented Information
without the permission of the United States Government, I
assign to the United States Government any money or other
thing of value which I receive or have already received for doing
so, or any right to receive such money or thing of value.

11. I understand that this Sensitive Compartmented
Information is now and will always be the property of the
United States Government. I agree that I will return all of
this information which I have or which I am responsible for
when I am asked for it by an authorized representative of
the United States Government. I understand that if I do not
return it when I am asked, this too may be a violation of
United States criminal law for which I can be punished.
1.2. Unless I am given written permission to do differently
by an authorized representative of the United States Government,
I understand that the conditions in this agreement will apply
to me during the rest of my life.
13. Nothing said in this agreement means that the United
States Government will give up any right it has to prosecute
me if I violate the laws of the United States. Also, nothing
said in this agreement means that I give up any basis for
defending myself if the United States Government 'tries to
prosecute me for violating the laws of the United States.
14. Each of the numbered paragraphs in this agreement
stands by itself. If a court decides that any of these
paragraphs do not apply to me, the rest of the paragraphs
will still apply.
15. 1 have read this agreement and I understand it. I
have asked any questions which I have about this agreement,

the laws which may apply to violation of it, and the rules
and regulations which governthe handling and storage of the
Sensitive Compartmented Information, and my questions have been
answered in a way that I understand.
16. I am making this agreement in good faith, and I
intend to live up to it.
