SUBJECT: Attached NSC Draft Directives and Possible Amendments
Thereto.

le Lack of Authority for Collection
(a) The provisions of Paragraph d (3}, Section 102 of the National
Security Act of 1947 allow the Director of Central Intelligence to cor-
relate, evaluate, and disseminate intelligence relating to the National
Security, but omit any reference authorizing CIA to collect such intelli-
gence directly. The latter function is presumably covered in Paragraph
d (2) - allowing the Director of Central Intelligence to make recommenda-
tions to the NSC regarding coordination (coordination of collec-
tion is covered in IAC 3, which allows CIA overseas collection
functions with regard to economic and scientific information
only).
Paragraph d (5) - allowing the Director of Central Intelligence to perform
such additional services as the NSC determines can be more effi-
ciently accomplished centrally (authorizing such exclusive and
centralized collection activities as FBIB and OSO).
(b) The duties and responsibilities of the Director of Central Intelli-
gence are further outlined in IAC No. 1, which is the basic paper to
which implementing supplements will refer. The function of collection is
also omitted from this paper except insofar as it is understood in Para-
graph 3, "the Director of Central Intelligence shall cause to be centralized
or relocated such intelligence functions, including research and analysis,
as may ... be more efficiently performed thereby."
(c) In view of the responsibility of the Director of Central Intelligence
for the direct and active collection of certain types of intelligence infor-
mation, as well as for the exploitation of certain intelligence sources,
(in addition to or in place of collection now performed by the services),
a paragraph should be added to IAC No. 1 to ensure authority for the collec-
tion activities of OCD and 00. Otherwise, paragraph 3 should be rewritten
to include specific reference to collection somewhat as follows:
"The Director of Central Intelligence shall cause to be
centralized, allocated, or relocated, such intelligence
functions, inch collection, research and analysis,
as may, ... etc."" The fund n of dissemination is
adequately covered in Paragraph 6 of IAC 1 as presently
written.

(d) The changes indicated above will give sufficient basis for Im-
plementing Supplements IAC I/5 and 1/6, concerning Documents Branch
allocation functions and Contact Branch collection functions respec-
tively.
2. Foreign Document Exploitation
In order to clarify the responsibility of CIA in regard to the ex-
ploitation of foreign documents, and to prevent this agency from being
charged with document exploitation for non-intelligence purposes, it is
suggested that paragraphs 1 and 2 of IAC I/5 be reworded as follows:
"1. Exploit or allocate the exploitation of all
captured documents for intelligence informa-
tion related to the national security.
2. Exploit or allocate the exploitation of other
foreign documents, including periodicals and
the press, for intelligence information re-
lated to the national security."
3e Domestic.loitation
Certain minor changes in the text of IAC 1/6 have been recommended
informally by representatives of the intelligence agencies. These changes
have been unofficially approved by ICAPS, and are indicated on the attached
draft of subject paper.
4. Change in IAC 3.
(a) The title of IAC 3 should read "Coordination of Overseas Collection
Activities," unless the provisions of this paper are in en to apply to
both domestic and foreign collection activities of CIA and the IAC agencies.
5. Change in Implementing Supplements
All Implementing Supplements to IAC 1 at present refer to It... the
authority of paragraph 4...". In view of the fact that paragraph 3 is con-
cerned with centralization under the Director of Central Intelligence, and
paragraph 4 refers to the IAC departments and an interchange of intelligence
materials, it seems obvious that the supplements should refer to paragraph
3 for authority.
