Importation of Pistol into United States
1. It appears that the person in question cannot lawfully
bring the firearm into the United States. Title 18 U. S. C. A. s
922(1) provides that:
Except as provided in section 925(d) of
this chapter, it shall be unlawful for any per-
son knowingly to import or bring into the
United States... any firearm or ammunition....
2. The exceptions found in section 925(d) allow, inter
alia, the importation of unserviceable firearms or firearms
generally recognized as particularly suitable or readily adaptable
to sporting purposes (excluding surplus military firearms). These
and the other even less applicable exceptions do not seem to help
our friend.
3. The penalty for violation of 1922 is a fine of not more
than $5, 000, or imprisonment for not more than five years, or both.
Our friend should be advised that the U. S. gun regulations are not
to be taken lightly.
4. If our friend were exceptionally persistent in finding
a loophole, we might suggest he locate a licensed Virginia firearm
importer to bring the firearm in for him. That probably is possible
but I have not spent the time required to outline the procedure.
5. I can find no Virginia regulation requiring registration
of firearms.
