1. (Internal Use Only - JGO) I called Mr. A. Sidney Buford,
INA, in response to his earlier call to Mr. Houston, OGC, concerning
forthcoming hearings in the House Post Office and Civil Service Com-
mittee concerning the Ervin bill. I filled Mr. Buford in on the current
information available from the Committee and learned that the Department
has done little so far in the way of current review on preparation for the
hearings. Mr. Buford expressed his appreciation for the call and asked
that I contact his assistant, Mr. George C. Denney, the first of the week
since he himself will be leaving the city for a week or so.
2. (Confidential - JMM) Mr. Meyer, ADDP, and I accompanied
Messrs. David Abshire and John Baker, State Department, to a meeting
with Chairman George Mahon, House Appropriations Committee, and
Mr. Ralph Preston, Staff Assistant, regarding Radio Free Europe and
Radio Liberty. See Memo for Record for details. .
3. (Internal Use Only - JGO) Received a call from Mr. John
Martiny, Chief Counsel and Staff Director, House Post Office and Civil
Service Committee, concerning Chapter 55 of Title 5 of the United States
Code relating to pay administration. In reviewing a draft bill under study
by the Committee relating to premium pay for ammunition and explosive
handlers, Mr. Martiny noted that the Agency has not been exempted from
Section 5541 of Title 5 relating to premium pay and wanted to verify this
determination. Since the Agency is not exempted from the terms of the
act, he will word the proposed bill coverage to exclude the Agency. In
part, Mr. Martiny also noted that this proposal probably will not go far
but in any event could not be a vehicle for amending the basic act if the
Agency desires formal exclusion at this time- I fhainkad Mr_ Ma rf;,,tr far

Counsel, NSA, who told me that Admiral Gayler, Director, NSA, met
with Chairman Hanley, Employee Benefits Subcommittee, House
Post Office and Civil Service Committee, this morning and found him
apparently receptive. Chairman Hanley accepted an invitation to NSA
probably after he returns from a trip out of the country which will take
him away from Washington from 23 April to 3 May. old25x1
me that he learned separately that Chairman Hanley intends at this
time to schedule hearings on "Ervin bill legislation" starting around
11 May and running through 30 May. I thanked for the 25x
information.

5. (Secret - JMM) Met with Bill Woodruff, Counsel, Senate
Appropriations Committee, whom I briefed on Soviet ICBM deployment,
ABM developments; ChiCom nuclear facilities; surface-to-air installations
in Egypt; and Soviet 'Salyut'.' - launch.
I explained to Woodruff our plans for a solution to Radio Free Europe
and Radio Liberty. He said he could not predict Senator Ellender's reaction
to such a proposal, but at least initially it would probably be unfavorable.
Woodruff offered his personal advice that the Agency should not use up its
limited capital with Senator Ellender in order to save the Radios--that we
"might need it more later."
6. (Secret - JMM) Talked to Mr. Pat Holt, Senate Foreign Relations
Committee staff, who said they would like to schedule the Director to appear
before Senator Frank Church's Subcommittee on Western Hemisphere Affairs
to discuss U. S. policies and programs in on Tuesday or Wednesday, 25X1
4 or 5 May. Holt said that they would particularly like to make sure that
is "in the vicinit . " He said he considered the out- 25X1
standing U. S. expert and even if he didn't actua y testify the 25X1
Subcommittee would like to have him available so the Director could refer
questions to him if he so desired. I told Holt we wanted to be helpful but
this was something we just couldn't do. As an alternative, I suggested he
provide us with questions before the hearing on which we would be sure to
get the benefit of any input could provide before appearing. Holt
said he thought this might work if we would be sure our answers to these
questions were in no way coordinated with State or Defense. I said he could
be sure our answers would be our own. He said he would try to get the
Committee's approval in arranging this but could not make any commitment
in advance.
7. (Confidential - JMM) Called John Martiny, House Post Office and
Civil Service Committee staff, to say that we had sent over a letter to Chairman
Hanley, Employee Benefits Subcommittee, indicating our concern about legislation
before his Subcommittee similar to the-Ervin bill and suggesting that he note
this letter and let us know when it would be possible for us to meet with him
(Martiny) and Chairman Hanley to discuss our problem in more detail. He
said hearings were already scheduled and he would be in touch with us shortly.

1. (Secret - GLC) In a short meeting with Senator Margaret Chase
Smith (R., Maine), I gave her the essential facts concerning new information
on Soviet ICBM silos and the Moscow ABM system. I told the Senator we
thought she would want this information prior to hearing the testimony of
Defense witnesses this week and offered to have Mr. Duckett give her a
detailed briefing at her earliest convenience. The Senator said she had
wanted to contact us for a briefing last week, but just had been unable to
arrange it. She expressed her thanks for the information and said she would
be in touch with us about a briefing in the next few days.
2. (Confidential - GLC) Mr. Charles Kendrick, Administrative
Assistant to Senator Peter Dominick (R. , Colo. ), called and said that on
his recent trip to Denver he had questioned Colorado State tax authorities
on the matter of exemption of CIARDS annuities under the State tax statutes.
The tax people told Kendrick the Colorado law was specific in exempting only
Federal Civil Service Retirement annuities and had to be strictly construed
to exclude CIARDS and Foreign Service annuities. Kendrick said he planned
to prepare a letter for the Senator's signature to the State tax authorities
on the subject. I suggested that he press the issue on the ground that such
an interpretation was discriminatory in its application against other Federal
civil retirees who had retired under retirement programs comparable to
the Civil Service Retirement Act. Kendrick said he would do this, but he
feels this is a matter which will probably require amendment to the Colorado
tax statutes.
3. (Confidential - GLC) Mr. Vince Rakestraw, Legislative Assistant
to Senator William B. Saxbe (R., Ohio), visited the Agency for lunch. He
expressed interest in the type of legislation which concerns the Agency and
we briefed him on the nature of CIARDS amendments and problems on legis-
lation like the Ervin bill and the Case resolution on the subject of international
agreements. We will provide Rakestraw with a Dopy of Qur package outlining
the problems which the Ervin bill poses for us.
