This is a final response to your 16 May 2002 Freedom of Information Act
(FOIA) request (and clarification letter of 12 September 2002) for records pertaining
to terrorists and terrorism. We processed your request in accordance with the FOIA,
5 U.S.C. ? 552, as amended, and the CIA Information Act, 50 U.S.C. ? 431. Our
processing included a search for records as described in our acceptance letter existing
through the date of that letter, 5 June 2002.
We completed a thorough search for records responsive to your request and
located material that we determined is properly classified and must be denied in its
entirety on the basis of FOIA exemptions (b)(1), (b)(3), and (b)(7)(A). An explanation
of exemptions is enclosed.
We located United States Government material that CIA did not originate; we
have referred this material to its originating agency for review, as it appears to be
relevant to your request. That agency will respond to you directly.
You have the right to appeal these decisions, as well as the decisions made in
our letter of 5 June 2002, by addressing your appeal to the Agency Release Panel, in
my care, within 45 days from the date of this letter. Should you choose to do this,
please explain the basis of your appeal.
