TIME Magazine 555 12th Street, N.W., Suite 600 Washington, DC 20004 Reference: F-2006-00175 The office of the Information and Privacy Coordinator has received your 3 November 2005 Freedom of Information Act (FOIA) request for the following records: 1. A copy of the 9/11 report by I.G. John Helgerson; and any and all I.G. reports or other documents relating to the investigations of `rendition' and the treatment of post- September 11 detainees anywhere in the world by CIA employees or contractors. 2. Any inter- or intra-Agency cables, emails, memos, notes or other communications, including memorializations of phone calls, on these topics. 3. Any and all documents such as but not limited to the genres of documents referenced above mentioning Vice President Cheney and his aides. 4. Any and all reports relating to the Niger-Yellowcake matter and former Ambassador Wilson's trip relating to it. We have assigned your request the reference number above. Please use this number when corresponding so that we can easily identify it. With regard to your request for a fee waiver, in accordance with section (b)(1) of subpart 1900.13 of title 32 of the Code of Federal Regulations, I have determined that, as a matter of administrative discretion, it would serve the interests of the Government to grant your fee waiver request only for the I.G. Report on 9/11 referenced in item 1. However, regarding items 1 and 4, we received earlier identical FOIA requests for the CIA Inspector General's 9/11 report, and for records relating to the Niger-yellowcake episode. Thus, in the case of item 4, because search and review fees are borne solely by the original requester, you are responsible only for a reproduction charge of ten cents per page beyond the first 100 pages, which are free. We note your stated willingness to pay `news media' fees up to a maximum of $200. We will send you the same CIA-originated records, if any are released to the original requesters, once these prior requests are completed. Because of our backlog, I cannot say with certainty when that will be. Regarding the remainder of item 1, and items 2 and 3, we cannot process these items of your request. Our analysts have reviewed your letter and are unable to determine what records you are seeking. For your information, the FOIA provides for public access to."reasonably described" records. This means that documents must be described sufficiently to enable a professional employee familiar with the subject to locate the document without an unreasonable amount of effort. Commonly this equates to a requirement that the documents must be locatable through the indexing to our various records. Moreover, the appropriate components have advised that your request is too broad and cannot be searched as stated. Your requests on these items need to be more specific for more efficient processing.
