This is further to our letters dated 13 and 23 February 2007 regarding your
3 November 2006 requests "under the provisions of 5 U.S.C. ? 552b, as amended" for the
following:
"1) ...each such Interagency Agreement between the Office
of the Director of National Intelligence and the Library of
Congress Federal Research Division, during the time
period January 1, 2000 to the present
For each agreement, [you] also request a copy of
2) The Statement of Work; and
3) the Federal Research Division work proposal."
During our processing of these requests, we determined that we accepted them
under the Freedom of Information Act (FOIA), in error. You did not submit your requests
under the FOIA and the statutory provisions under which you have requested these records
do not apply to the CIA. Therefore, we cannot accept your requests under 5 U.S.C. ?
552b, as amended.
This cancellation does not prevent you from requesting this information under one
of the CIA's release programs outlined in the CIA's regulations in title 32 of the Code of
Federal Regulations.
