Suite 500 Washington, D.C. 20036 Pursuant to the District of Columbia District Court decision in National Security Archive v. Central Intelligence Agency, we are initiating the processing of National Security Archive cases held in abeyance pending resolution of fee issues. Your request, formerly F89-1132, has been assigned reference number F92-0896 for identification and tracking purposes. Specifically, you are requesting all records "relating to Manucher Ghorbanifar, an Iranian-born businessman described in detail in official United States investigations into the Iran-Contra affair, including the Tower Commission and the joint select Congressional Iran-Contra affair, including the Tower Commission and the joint select Congressional Iran-Contra committee inquiry, as playing an integral role in the affair." We have accepted your request; it will be processed in accordance with the Freedom of Information Act (FOIA), 5 U.S.C. 552, as amended, and the CIA Information Act, 50 U.S.C. 431. Our search will be for documents in existence as of and through the date of this acceptance letter. With respect to your request for a fee waiver, we have considered the subject of your request against our Rules and Regulations as published in the Federal Register, as well as relevant Department of Justice and Office of Management and Budget guidelines, and determined that no fees will be charged in this particular instance. The heavy volume of FOIA requests received by the Agency has created delays in processing. Since we cannot respond within the 10 working days stipulated by the Act, you have the right to consider this as a denial and may appeal to the CIA Information Review Committee. It would seem more reasonable, however, to have us continue processing your request and respond as soon as we can. You can appeal any denial of records at that time.
