Pursuant to Section 2.4 of Executive Order 12863
(E.O. 12863. or E.O.), "President's Foreign Intelligence Advisory
Board," (PFIAB) I am submitting this quarterly report for the fourth
quarter of calendar year 2006.
In accordance with guidance from the Assistant to
the President for National Security Affairs dated 18 August 2006, I
am sending this report to you, as the General Counsel of the PFIAB,
instead of. to the Chairman of the Intelligence Oversight Board
(IOB). It is provided to you in addition to the quarterly report
you may receive from the Central Intelligence Agency's (CIA) Office
of Inspector General. As you know, the Executive Order (E.O.)
requires me to report intelligence activities that. I have legal
reason to believe may be unlawful or contrary to E.O. or
Presidential directive. Since my last report, I am aware of three
reportable items, which are listed below. Note in particular item
one below, which was reported to the congressional oversight
committees as a spot report.
